Welcome to Dash Me! These Terms and Conditions (“Terms”) govern your use of the Dash Me mobile application and related services (“App” or “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
1. Introduction
Dash Me is a food delivery service operated in the British Virgin Islands (“BVI”).
The Service connects users with local restaurants and delivery personnel to facilitate the ordering and delivery of food and beverages.
2. Eligibility
You must be at least 18 years old to use the Service.
By using the Service, you represent and warrant that you have the legal capacity to enter into these Terms.
3. Account Registration
To use the Service, you must create an account by providing your name, email, phone number, and other required information.
You are responsible for maintaining the confidentiality of your account information and password.
You agree to notify us immediately of any unauthorized use of your account.
4. User Responsibilities
You agree to provide accurate and up-to-date information when creating your account and placing orders.
You are responsible for ensuring that your order details are correct before submitting them.
You must comply with all applicable laws and regulations while using the Service.
5. Ordering and Payment
Prices for food and delivery are displayed in the App and are subject to change.
Payment must be made at the time of placing the order using the payment methods provided in the App.
Payment Gateway: Dash Me uses First Atlantic Commerce (FAC) as its payment gateway for processing transactions.
Bank: All payments are processed through Republic Bank (Road Town Branch), located in the British Virgin Islands.
By placing an order, you authorize Dash Me to charge your selected payment method for the total amount of your order.
6. Delivery
Estimated delivery times are provided for convenience and are not guaranteed.
Delivery may be subject to delays due to traffic, weather, or other unforeseen circumstances.
If you are not available to receive your order at the specified delivery address, you may be charged a re-delivery fee.
7. Cancellations and Refunds
Orders cannot be canceled once they have been confirmed.
Refunds may be issued at our discretion if there is a problem with your order, such as incorrect items or delivery issues.
8. User Content
You may submit reviews, ratings, and other content through the App.
By submitting content, you grant Dash Me a non-exclusive, royalty-free, perpetual, and worldwide license to use, modify, and display your content.
You agree not to submit content that is unlawful, defamatory, or infringes on the rights of others.
9. Prohibited Activities
You may not use the Service for any illegal or unauthorized purpose.
You may not interfere with or disrupt the operation of the Service or the servers and networks used to provide it.
You may not attempt to gain unauthorized access to any portion of the Service or any other accounts, systems, or networks.
10. Intellectual Property
The Service and its content, including text, graphics, logos, and software, are the property of Dash Me or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not use, reproduce, or distribute any part of the Service without our express written consent.
11. Third-Party Links
The App may contain links to third-party websites or services that are not owned or controlled by Dash Me.
Dash Me is not responsible for the content, privacy policies, or practices of any third-party websites or services.
12. Disclaimers
The Service is provided on an “as is” and “as available” basis. Dash Me makes no warranties or representations regarding the accuracy, reliability, or availability of the Service.
Dash Me disclaims all warranties, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
13. Limitation of Liability
To the fullest extent permitted by law, Dash Me shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Service.
Dash Me’s total liability to you for any claim arising out of or in connection with these Terms or the Service shall not exceed the amount you paid for the Service.
14. Indemnification
You agree to indemnify and hold Dash Me, its officers, directors, employees, and agents harmless from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the Service or your violation of these Terms.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the British Virgin Islands.
Any disputes arising out of or in connection with these Terms or the Service shall be resolved through binding arbitration in the British Virgin Islands.
16. Modifications to the Terms
Dash Me reserves the right to modify these Terms at any time. The updated Terms will be posted in the App, and your continued use of the Service constitutes acceptance of the changes.

18. Miscellaneous

These Terms constitute the entire agreement between you and Dash Me regarding your use of the Service.
19. Force Majeure
Dash Me shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including natural disasters, acts of war, or other similar events.
